Waldron <br />Division of lvlinerals and Geology <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO $0203-2273 <br />ltE: M-2001-046; Nix Saad & Gravel Mine; Owens Brothers Concrete Company <br />Dear Tony: <br />Below is my response to the Wright Water Engineers, lnc. report titled EVALUATION <br />OF POTENTIAL IMPACTS FROM THE PROPOSED NIX PROPERTY SAND AND <br />GRAVEL OPERATION ON SHALLOW GROUNDWATER LEVELS, WATER <br />WELLS AND WETLANDS and dated April 2002, the text of which I received via email <br />the afternoon of April 18a' and the graphics of which I received on Apri122"~. <br />My concerns about the wetland mitigation procedures outlined in section 6.2 of the report <br />are as follows: <br />Augmentation Using Water From Mine Area 1 <br />As the main mitigation procedure, Wright Water Engineera {WWE) recommends in <br />section 6,2.1: that water be~brought to my wetland via apipeline/ditch from Mma Area 1, <br />entering the wetland at a location near the water control structure on the north end of the <br />slough. <br />A. The report; says the water will enter the slough at "the most upgradient (highest) <br />point possible," meaning the highest point allowed by using gravity feed. In a letter to <br />me from W WE dated April 18, 2202, W WE states that "the pipeline from newMi»ing <br />Area 1 Hill discharge to the shn~gh near the existing water control hvx". <br />if the water enters the slough near the water control structure on the north end of the <br />pond, the water will simply run back out through the water control stn~eture into the <br />barrow pit ditch which runs parallel to WCR 28. The water will not spread out or sink <br />into the wetland, but will simply follow the line of least resistance, which is to flow <br />downhill into the barrow pit ditch. <br />
