PART 1 <br />Page No. 3 <br />Permit No. COG-850000 <br />.1. COVERAGE UNDER THIS PERMIT <br />1. This general permit authorizes dischazges that consist entirely or principally of precipitation-induced surface runoff from aci~ <br />ferruginous coal mining and processing operations including loadouts, while active mining is occumng or during reclamation pri <br />final bond release, to land (as dust control), and into waters of the State of Colorado. If additional sources which the Division detemunes <br />to be minor in nature such as selected mine water, prepazation plant water, spoils spring water, runoff through refine piles, or other <br />wastewater may be discharged. -These sources may be covered under this permit at the Division's discretion, providing that such <br />wastewater would not require effluent limitations and/or monitoring requirements other than those contained in this permit. Such <br />determinations will be made on a case-by case basis upon review of the permit application and any additional relevant information. This <br />permit does not cover underground mining. If discharge from one or more ofthe above listed sources require additional limitations <br />and/or monitoring requiremenu, an individual permit maybe requued. Multiple discharge points from one facility maybe authorized <br />through this permit providing all meet these criteria. <br />2. In order to apply for certification under this general permit, the owner, operator, and/or authorized agent ofthe subject facility shall <br />submit by certified mail or hand delivery, the completed Coal Mining Wastewater Dischazge Application (famished by the Division) <br />which generally requires the following information (at a minimtun): <br />a. Name, address, and descriptive location ofthe facility; <br />b. Name of principal in charge of operation ofthe facility; <br />c. Name of immediate receiving waters, (including irrigation ditches, intermittent streams and dry drainage, as applicable); <br />d. Description of the type of activity(ies) resulting in the discharge, including the anticipated duration of the activity and/or the <br />discharge, anticipated volume and rate of discharge, and the source(s) of water to be dischazged; <br />e. Description of any wastewater treatment system(s) and recycle/reuse utilized; <br />f An 8'h x 11 inch map showing the general geographical location ofthe facility and any neazby landfills, mine or mill tailings, or any <br />other known or suspected sources of pollutants; <br />g. An 8 %, x 11 inch sketch ofthe facility showing all structures, outfalls and receiving waters, as well as storage locations of any <br />petroleum or chemicals on site; and <br />h. A chemical analysis ofthe water to be discharged. If no water is available, this shall be indicated. <br />If the discharge is to a storm sewer system, ditch, or other manmade conveyance, approval from the owner of the system must be obtai~ <br />before discharge. <br />At least 30 days before the anticipated date of discharge, such information shall be submitted on the application form to: <br />Colorado Department of Public Health and Environment <br />Water Quality Control Division <br />WQCD-P-B2 <br />4300 Cherry Creek Drive South <br />Denver, CO 80222-1530 <br />The Division shall have up to thirty days aRer receipt ofthe above information to request additional data or deny the authorization to <br />discharge. Upon receipt of additional information, the Division shall Gave an additional 30 days to issue or deny authorization to <br />discharge. Ifthe applicant does not receive a request for additional information or a notification of denial fromthe Division within thirty <br />days, authorization to discharge in accordance with the temts and conditions ofthe permit shall be deemed granted. <br />if the Division determines that a new facility does not fall tinder the authority of the general permit, then the information received will be <br />processed for an individual permit and discharge will not be allowed until 180 days after the date the application was received. The <br />applicant shall be notified of such a determination. If during the renewal process, the Division determines that a facility no longer <br />qualifies for the genera] permit, the facility will be allowed to discharge under the general permit until an individual permit is issued. <br />3. Authorization to discharge under this general permit shall expire on June 30.2007. The Division must evaluate this general permit once <br />every five years and must recertify all applicants' authority to discharge under the general permit at such time. Therefore, a permittee <br />desiring continued coverage under the general permit must reapply by January 1, 2007. The Division will determine if the applicant <br />continues to operate under terms ofthe general permit. <br />• <br />
