..
Mined Land Reclamation
15 December 1978
Page - 4 -
Briefly, we have agreed to comply with the recom-
mendations of Soil Conservation. See also approval
by the County on this point.
III. Water Resources.
A. A dry pit, or pits. No water resources affected.
All water used in washing sand goes back into the ARROYO.
8 B. The well was adjudicated for 300gpm at the time
adjudication was required. We do not have the number
available.
And then you ask about Reclamation....again. We have
told you that no real pit exists when the sand is re-
moved. Livestock could walk in and out There is
no "drop" of any kind. A very gentle slope.
As for the gravel operation, again, only a hil side is
removed. There is no pit, no holes. Just flat land.
No drop. A minute slope. There is absolutely no need
to fence. Catle, or horses, just cannot fall in.
When will reclamation begin. The same half acre is
used often by heavy equipment. Seeding at this time
or at any time while the gravel pit is in operation
would be worse than useless
I would like to point out to you that these pits have
been in operation for years and years. I arrived here
shortly after WW II in 1946, and the pits were then old.
As for V. Hills objection. The road to the pit travels
through a very short piece of his land, not more than
150 feet. The road is a County road. About 1950, Hill
tried to close this road, but failed. I was the lawyer
who opposed him. His property does not touch the land
where the pits are located. See his own map. He has
a dilapidated shack on his place that is a haven for
mice and rats....not habitable. He may have abandoned
his right to use water from the City lines that pass
near his property, and how he could ever get a build-
ing permit is a mystery to me since he does not have
sufficient land on which to construct a leaching field
so close to an open ditch carrying domestic water.
As for the easement he lists with his objection, it
was enteredinto with absolute strangers to the title
and why they paid Vehill for this is unknown. The deed
to him does not mention a right of way. He himself has
not used this road for many many years.
Anything further, PHONE. COLLECT.
$~spectful`l'y
ERNEST U.
