wildlife resources information indicates that a biological community as defined at <br />Rvle 9.05. 18(3), is present in a stream reach upgradient of the Loadout permit <br />area (see Tab 11). In addition, the U.S. Fish and Wildlife Service has indicated <br />they would like to see habitat associated with Dry Creek protected (see Tab 11). <br />Therefore, a stream buffer zone will be established (see Tab 21). <br />Disturbances within and immediately adjacent to Dry Creek are limited to the <br />following existing structures: 1) two railroad crossings of Dry Creek; and, 2) <br />Pond 2. The railroad crossings and the sediment pond have been designed and <br />constructed to minimize disturbances to the stream segment. The original main <br />channel of Dry Creek has not been either diverted or realigned in conjunction with <br />any of the above mentioned structures. The railroad crossing culverts and the <br />sediment pond axe properly designed (will safely convey/detain the runoff of a 10- <br />year, 29-hour storm) to prevent water quality degradation in Dry Creek as a result <br />of the embankment disturbances. No additional channel disturbances are <br />contemplated. <br />After termination o£ activities at the Loadout facility, the railroad crossing • <br />culverts and Pond 2 will be removed and reclaimed. Reclamation will include <br />regrading, replacement of suitable salvaged topsoil, and revegetation. Tabs 17 <br />(Reclamation Schedule), 18 (Backfilling and Grading), 19 (Topsoil Handling Plan) <br />and 20 (Revegetation Plan) provide more detail regarding reclamation activities <br />planned for the railroad culverts and Pond 2. <br />Water Rights and Alternative Water Supplies <br />A listing and map of water rights in the vicinity of the Loadout facility is <br />presented in Attachment 19-1. Additionally, an investigation report and <br />comprehensive listing of water rights in the Dry and Sage Creek drainages are <br />presented in Attachment 19-2. Table 19-1 presents a listing of water rights that <br />will be transferred to Hayden Gulch Terminal, Inc. (HGTI). The well permit <br />associated with the H-G Shallow Well No. 1 (NO. 29576-F) will also be transferred <br />to HGTi. <br />The H-G Shallow Well No. 1 is a 3-foot diameter clearwell (19 feet deep) completed • <br />in the Yampa River alluvium. Water from this well will be used for dust control, <br />TR-07 4 Revised 03/06 <br />
