Mr. DiRezza has agreed to reclaim all pre-existin dis- <br />turbance within the boundaries of the designated acre as <br />shown in Exhibit C-3. Of course he also agrees to re laim <br />any additional disturbance his mining operation will ncur <br />in the designated area. All reclamation will be done in <br />accordance with Exhibit E, Reclamation Plan. <br />2. Believe me, there is more than enough waste mater: <br />backfilling requirements on the perimeter, slopes. It <br />because of excessive spoil piles dating back 80 years <br />we wanted to avoid the obligation to reclaim the pre-E <br />condition in the first place. But that is resolved it <br />above. <br />3. No comment. <br />Exhibit D <br />1. No brush piles will be established because the <br />be reclaimed for pasture. <br />Exhibit E <br />1. Our intention has always been to determine the va' <br />Phase 3 by our findings along the boundaries of Fhase <br />1B and Phase 2.
