STONE AVE. <br />PHONE (718) 520-8840 <br />FAX (719) 5208876 <br />TO: Beth Whittier, County Attorney <br />FROM: Merv Casey, Systems Supervisor, DO <br />RE: Performance Warranty for Mineral Extraction Site <br />Subsequent to a review of several of our gravel pits with James <br />Dillie, a representative of the State Department of Natural <br />Resources, he discovered that E1 Paso County had never submitted a <br />Performance Warranty for one of the reviewed pits. The state has <br />asked that we submit such a Warranty. <br />In checking with Mr. Dillie it appears that none of the permits <br />issued during the 70's and 80's have a performance warranty. I <br />suspect that at the time the sites were permitted such warranties <br />were not required by the regulations. <br />Our Department is presently evaluating the need for the existing <br />operations and have decided to remove several from our inventory. <br />As a matter of fact several pits are presently undergoing the final <br />stages of reclamation. I would suggest that as the warranty is <br />directed at reclamation we need not warrant what we have already <br />accomplished. <br />However it might be prudent to submit to the Board for their <br />approval the following warranties for those pits that we plan to <br />keep for one reason or another for at least the foreseeable future. <br />I'm sure the state will ask for such warranties as they review the <br />several pits over the next few months.
