Doerfer <br />RE: Review of March 19, 1990 Response to Adequacy Review, <br />Platte Valley Pit, C&M Companies, File No. M-89-120 <br />I have reviewed the responses received on March 19, 1990 to the Division's <br />adequacy concerns. My comments following review are provided below: <br />4. The plan to provide us prior to the board with he water court filing to <br />demonstrate water rights for reservoir storage is acceptable. This also <br />alleviates the need for an alternate reclamation plan. We may need, <br />however, to pursue a conditional lease or first lien on these rights <br />consistent with Division policy in this respect. <br />6. TFte decision to retain the original plan for two lakes alleviates our <br />concerns on the stability of the one-lake plan. <br />11. The length of spillway in the lateral berm has been specified and appears <br />adequate. <br />12. The length of pond perimeter overtopped during flood was estimated at <br />B00 feet. This is essentially the entire length of pond on the <br />downstream side. The argument that this entire area would be inundated <br />during a large flood is correct. I will defer to the Urban Drainage and <br />Flood Control District comments in this regard. We can expect a comment <br />letter from UDFCD prior to Board consideration. <br />16.
