<br />• EXHIBIT C <br />The attached map for Exhibit C indicates, as do all maps <br />prepared as exhibits for this Application, the total area which <br />has been mined on the Headley lands. However, certain of the <br />areas included within that total area had been mined previously <br />to Headley's commencment of operations. The following summa- <br />rizes the history of the pre-Headley operations with attached <br />documentation as well as history of the Headley operation since <br />1976. <br />In 1963, Morgan County excavated material from Antelope <br />Draw, in the SW corner of Section 20, TSN, R55W. In the fall <br />of 1964, Peter Kiewit Sons Co. did exploration in the S 1/2 <br />of Section 20 and in Section 29, TSN, R55W, finding extensive <br />gravel deposits particularly in Section 29. Tests were made <br />and the entire area was drilled every 100 feet to shale in a <br />checker-board fashion. However, Peter Kiewit failed to get <br />the bid for the project. Operations were not continued in <br />Section 20, but Schultz & Lindsey corporation from Fargo, <br />North Dakota took up the drilling operation abandoned by <br />Peter Kiewit and completed exploration, including open exca- <br />• vation in Section 29 after cahich a contract was signed as <br />indicated by the attached exhibit. <br />Schultz & Lindsey continued mining in Section 29 through <br />the winter of 1964 and during the year 1965, ultimately re- <br />leasing the contract to the State of Colorado as per the <br />attached exhibit. Schultz & Lindsey left large areas of stock- <br />piled processed waste material on the lands without any reclama- <br />tion. They also failed to slope the pits or clean up the area <br />in any way, but the State of Colorado, in their assumption of <br />the contract stated that they would now finish the areas <br />affected by the Schultz & Lindsey operations. This was not <br />done, as the photo from the Denver Post of 1972 attached <br />will show. During and after completion of the Schultz & <br />Lindsey and State operations, Morgan County has operated <br />extensively out of the pits in Section 29, as has Washington <br />County. Before 1976 Headley was farming the lands in the <br />immediate vicinity plus two other farms for a total of 660 <br />irrigated acres as well as raising cattle. Headley, in fact, <br />sold gravel to those who are operating out of the pit but <br />did not work the gravel pits prior to 1976. Other attach- <br />ments to this exhibit verify the sale of gravel and indicate <br /> <br />
