Uclo,{' the permit area boundary, you will havc to obtain a discharge permit. Your response to this item may consist
of the strornnvater control plan you have prepared and provided to the Water Quality Control Division.
13. The uorthcnt access road, which will be used to provide initial access to the pcnnit area, presently exists and as
such does not havc to be included in the permit area. The proposed future access road to be built from the south
dots not prescotly exist, and therefore must be included in the permit area acreage. This secondary access road
must be added to the Icgal description and depicted on the maps as being included within the permit boundary.
(Does the land to be affected by this future access road account for the "missing" 0.06 acres noted above?) Though
these questions arc n+sed under this exhibit, please make any needed changes to the appropriate exhibits (Exhibit A
and F.,).
14. Since the proposed access road is partly within the CDOT nght-of-way artd not ou the property parcel, you
must also ensure that you provide evidence of the Icgal right to enter that area of land owned by CDOT. Tl+ough
this point is stated under this exhibit, please provide the needed documentation under Exhibit F or G.
15. Ple;+se state at what point in the development of each bench Ure northenr slope will be graded and "reclaimed."
Will i[ be at the. point of full excavation of each bench, or at the conclusion of cxa3vating all three Ucnches'?
I;xhiUit D -Acclamation Plan (Rule 6.3 4)
lG. The seed mix you havc proposed looks very good. Your plan states that the seed will be Uroadcast ou the
roclvmcd 3: I slopes. Revegctation success is enhanced by incorporating the seed into the soil snrfacc, usually by
raking or tracking it by dozes Please state what method you will use.
17. The plan states that roads will remain o+uite after reclamation. The access roads arc depicted, but they do no[
appear [o access all benches. ~inc~rc will the road to the upper Uench be located'? Since this site averages greater
than 20"/o slope, cnst+ring long-term road stability is an important issue. Plcasc describe the road location, its
surface material and slaps. As appropriate, please also include it on the reclamation map. If needed, we may
approve that a road(s) of certain specifications will remain, but at a location(s) to be determined later.
Exhibit E -Mining and Reclamation Maps (Rule 6.?.5)
18. L+ the questions in dte preceding paragraphs I havc made numerous reference to the recd to rccise the maps to
reflect all new iufornration Using added to the boundary description, landoHmcrslvp, roads, slope and drainage
patterns, and details of the mining plan and elclamation plan. Along with the changes noted above, please also
correct the titles of both of these maps. They must show the correct exhibit (Exhibit E) plus more clearly identify
which plan they depict. Ptcasc review Rule 6.2.1 also.
Gcotcchnical Stability Exhibit Rulc G.5
19. You provided a supplemental engineering evahiation of the slope stability, for the bench slopes and the
"roclain+ed" slopes. Bench slopes were modified to be a maximum of L5: 1, while the reclaimed slopes remain at
3:1. 'Ibis change is appreciated, since the initial gradient proposed would have been difficult if not impossible to
maintain ou this type of material. However, as your evaluation stated, stability will havc to be monitorod, and
corrected if nccossary This slope change should be included ou the areas depicted on the revised maps.
Additional Items
2U. Plcasc Uc reminded that you were to publish a Icgal notice within 10 days of "filing' your application with the
Division, as the Division's December 17, 2001, letter instructed. To verify such timely publication, we rcquiro that
you subnut a notarized affidavit from the publisher, but havc not yet roccived one If you havc published, please
obtain the afridavit mrd forward it to this office. If you have not yet published the notice, please do so promptly,
ensuring that [Lc correct date is inserted in the notice to describe the ten-day public comment period. The requirod
format is included in the permit application.
