It is expected there will be some evapora- <br />tive loss from these lake surfaces. <br />Water to be used in the revegetation program is <br />minimal. Grasses will be seeded, fertilized and mulched <br />and trees will be planted as described in Exhibit E. The plan <br />does not call for watering of the grasses and trees. <br />Where possible, overburden material will be used to <br />backfill and reduce water area, thus minimizing any <br />evaporation effects. <br />The operator's intention is to minimize disturbances <br />to the prevailing hydrologic balance of the affected land <br />and of the surrounding area and to the quality and quantity <br />of water in surface and ground water systems, both during <br />and after the mining and during reclamation. Valco believes <br />it is in compliance with federal and state laws and regula- <br />tions governing water and water rights. There is no applica- <br />tion of the dredge law or siltation structure removal require- <br />ment. <br />It is not expected that these ongoing operations will <br />cause measurable, material injury to senior water rights. <br />25 <br />
