Now that it has become clear that the Colorado Lime Company (CLC) property <br />boundary (includes an easement of a portion of the Docter number one claim) is the same as the <br />affected land boundary which is the same as the permit boundary, there are certain issues that <br />need to be addressed. The concerns will be listed using the same format that was used in the <br />December 6, 2000 adequacy letter. <br />5) Rule 6.4.3 -Your location map, which is supposed to show adjacent surface owners, does not <br />show Ms. Gloria Brown's home site. Since the northern boundary of the affected land is within <br />200 feet of her lot, you must show the location and ownership on this map. Also, you need to <br />address the structure in Exhibit S. <br />6) Rule 6.4.3 -The Mining Plan Map must clearly show the areas that are to be mined and the <br />direction of mining. The map you submitted adequately shows the direction of mining the waste <br />dump but does not show the limestone or dolomite mining areas or the direction of mining. Your <br />February 23, 2001 response to the Division's December 6. 2000 adequacy letter states that the <br />"Location of a specific mining area can not be shown at this time." However, you also state that <br />"Prior to mining by the drill and blast method, the operator shall submit to the Department of <br />Minerals and Geology a detailed site specific plan of the area to be mined, the height and width <br />of the benches, stockpile of ore and overburden, if there be any, together with a geotechnical <br />evaluation by a licensed engineer all in compliance with rule 6.5..." This will require the <br />submittal, and approval, of a technical revision which would include an updated map as well as <br />all other pertinent information including the area(s) that will be used to temporarily stockpile the <br />excavated overburden material. If, after completing the geotechnical evaluation, there are <br />sienificant changes in the mining plan or reclamation plan, once a specific mining area is located, <br />the revision submittal may require an amendment application. Permit approval will include a <br />condition requiring a revision submittal, and approval by the DMG, prior to disturbing any <br />
