BANTA, Dlroctor <br />July 26, 1989 <br />Ms. Sandra Pautsky <br />Pueblo Coal, Inc. <br />400 First National Building <br />Wichita Falls, TX 76301 <br />Re: Carbon Junction Mine Permit Renewal (File No. C-82-054) <br />Dear Ms. Pautsky: <br />The Division staff have discussed your proposal to accept the Letter of <br />Agreement between the Colorado (dined Land Reclamation Division and <br />Pueblo Coal, Inc. with the provision that the deadline for submittal <br />of additional reclamation bond be delayed until May 30, 1990. At this point, <br />the Division cannot agree to an extension of that length. As you are aware, <br />the permit renewal has been pending for nearly a year, with additional <br />informational deficiencies dating from the mid-term conducted in 1986. <br />The bond calculation performed by the Division staff was preliminary in <br />nature, based on information available to us at the time. Often the permittee <br />has information, which when submitted lowers the calculated dollar amount <br />of the reclamation bond. One suggestion would be for Pueblo Coal to conduct <br />its own reclamation cost analysis, with staff assistance and input. If the <br />total dollar amount was reduced a3 as result of this analysis, the Division <br />would accept bond in that amount. <br />However, the Division cannot extend the renewal review period without a <br />commitment regarding submittal of an adequate surety. <br />We would be happy to discuss any option with you at your convenience. <br />Sincerely, <br />Michael B.
