with appropriate documentation of the evaluation submitted to the Division in letter form
within one working week after completion of the excavation.
3. Sediment pond B embankment
The report found the sediment pond embankment will be stable during the operation of the
mine and after reclamation. However, geotechnical exploration was not completed at the
location of the proposed sediment pond. Therefore, the Operator will conduct additional
borings and laboratory evaluation of the subsurface soils at the proposed location of
sediment pond B in order to verify or modify the assumptions made in the geotechnical
designs. Results of this evaluation will be submitted to the DMG prior to construction of
sediment pond B.
The Terracon report recommends an engineering evaluation of actual conditions
encountered in the excavation to verify the conditions correspond favorably with the
assumptions made in the stability analysis. Therefore, the Operator commits to the
following:
An engineering evaluation of actual conditions will be conducted to verify the assumptions
or modified assumptions used in the geotechnical designs for the proposed excavation and
embankment work for sediment pond B. This evaluation will be conducted by a qualified
• geotechnical professional. The evaluation will be performed contemporaneously with the
excavation. The Division will be verbally notified of the results of the evaluation
immediately following the excavation with appropriate documentation of the evaluation
submitted to the Division in letter form within one working week after completion of the
excavation.

PR-03 - 2 - 10/99
