Office of the State Engineer <br />In a letter addressed to Deb Gonima at the DRMS, dated February 28, 2007, <br />Sarah K. Reinsel, E.I.T, noted the condition for approval is that there will be no <br />exposure to groundwater during and after mining operations. Stormwater runoff <br />intercepted must be released to the stream system within 72 hours; the applicant <br />will adhere to this rule. <br />The applicant stated in the 112 permit application that it did not anticipate <br />exposing groundwater; there will be no groundwater impacts. In the unanticipated <br />event that the applicant comes within 2 feet of groundwater, the area will be <br />backfilled to avoid exposing any water surface. The applicant also understands <br />potential requirement of additional approvals (e.g., substitute water supply) <br />should the water rights of any other party be impacted by the operation. <br />C. Elbert County Road and Bridge <br />In a letter dated February 28, 2007, Tim Sheridan summarizes his <br />recommendations for stipulations to control the mining land use in Elbert County. <br />These recommendations are a recapitulation of the existing Elbert County <br />Conditional Use Permit. In accordance with state statute under the Construction <br />Materials Act, local regulatory enforcement is not a state permit issue, but the <br />applicant commits to complying with all Elbert County Road comments and <br />requirements. <br />9. Please confirm that if topsoil stockpiles are to be left in place for one year <br />or longer, the temporary seed mixture, as recommended by the NRCS, <br />will be applied. <br />The applicant will apply the temporary seed mixture recommended by the NRCS <br />to topsoil stockpiles if they are left in place for longer than one year. Most topsoil <br />will be replaced in concurrent reclamation during annual campaign mining. <br />10. Please provide anticipated quantity (cubic yards) of construction stockpile <br />material on-site at all times. <br />Based on the annual campaign maximum impact scenario, there will be four <br />types of material to be stockpiled on site at any given time: topsoil, overburden, <br />waste, and clay to be shipped. Without concurrent placement of reclamation <br />backfill, the topsoil stockpile could have 2,520 cubic yards of material, the <br />overburden stockpile could have 5,040 cubic yards of material, and the waste <br />stockpile will have up to 54,700 cubic yards of material.
