Kiowa Clay Mine, M-2007-009 <br />Response to Adequacy Comments <br />17 April 2007 <br />Page 13 <br />Regarding the Division's inspection report, the applicant concurs that no active <br />well is located on the site, and no historic physical well location within the <br />boundary of mining or the affected area is apparent or verifiable applying all <br />reasonable diligence. <br />Finally, please note that the applicant has been in contact with Elbert County, as <br />well as neighbors of the project. Elbert County requested relocation of the <br />access drive to a high point south of the existing access on Elbert County Road <br />89. The enclosed Revised Exhibit C-3 (Mine Plan) and Revised Exhibit F <br />(Reclamation Plan) reflect technical changes prompted by these discussions, as <br />well as responses to the Division's adequacy review. The change to the access <br />location does not affect the applicant's prior compliance with Rule 1.6.2, as the <br />landowners along County Road 89 were all notified; no change affecting the prior <br />list of noticed parties is triggered by the relocated access point. <br />We look forward to working with you to finalize this 112 Reclamation Permit prior <br />to the decision date in May.
