Kiowa Clay Mine, M-2007-009
Response to Adequacy Comments
17 April 2007
Page 13
Regarding the Division's inspection report, the applicant concurs that no active
well is located on the site, and no historic physical well location within the
boundary of mining or the affected area is apparent or verifiable applying all
reasonable diligence.
Finally, please note that the applicant has been in contact with Elbert County, as
well as neighbors of the project. Elbert County requested relocation of the
access drive to a high point south of the existing access on Elbert County Road
89. The enclosed Revised Exhibit C-3 (Mine Plan) and Revised Exhibit F
(Reclamation Plan) reflect technical changes prompted by these discussions, as
well as responses to the Division's adequacy review. The change to the access
location does not affect the applicant's prior compliance with Rule 1.6.2, as the
landowners along County Road 89 were all notified; no change affecting the prior
list of noticed parties is triggered by the relocated access point.
We look forward to working with you to finalize this 112 Reclamation Permit prior
to the decision date in May. Please do not hesitate to contact us at any time with
questions or comments.
Sincerely,
BANKS AND GESSO, LLC
4~
O
Alex
cc: John Cona, Acme Brick Co.
encl: Affidavit of Publication, Elbert County News
Copies of Certified Mail Receipts
Postmarks and Tracking Information Concerning Sandford Family Trust
Copy of Signed Structure Agreement from Mountain View Electric
Copies of Certified Mail Receipts, Structure Owners (Elbert Road &
Bridge]
Revised Exhibits C-3 and F
Index Map and Well Records for Site Vicinity
