Welcome to the new board members; Gilbert Slade, Dickey Lee <br />Hullinghorst and Terry D'Connor. <br />b. Legislative update. <br />c. Meeting regarding coal regulations and the possibility <br />of modifications to improve the state program. Steering <br />committee to be established to create proposals of change. <br />AGENDA ITEf4 4 - FORMAL PUBLIC HEARING - <br />All persons wishing to give testimony in this matter, File No. 83-39, <br />were sworn by the Chairman. <br />Staff presentation was made by Reclamation Specialist Supervisor, Joe <br />Lalkind, regarding a formerly unpermitted pit operated by the Las Animas <br />County Commissioners. The permit has been issued, approved by the board <br />at the April Board Meeting. Civil penalties were assessed in the amount <br />of $10,000 with $7,000 to be suspended upon issuance of the permit. <br />There was, therefore, a $3,000 unsuspended civil penalty, payment deferred <br />to this board meeting allowing the county to submit a plan for additional <br />reclamation work in the amount of $3,000. The county has submitted that <br />plan for consideration at this board meeting. The plan is for approxi- <br />mately 5 acres. Mike Stanton has reviewed the plan as submitted and <br />outlined that reclamation plan to the board <br />Staff recommended board approval of the reclamation plan as submitted <br />by the county and defer the payment of the unsuspended $3,000 civil <br />penalty until successful reclamation has been accomplished, one full <br />growing season. <br />It was i40VEU that the staff recommendation oe accepted by the board <br />with the provision that a prelimi ins ection be made to determine <br />the necessity of recla~nation~the site a~he staff would proceed <br />on its own judgment.
