<br /> W I T N E S S E T H :
<br /> WHEREAS, W. S. Dawson desires to conduct a(n) undergroundm nir:g
<br /> operation, known as THE IKE NI MINE for the purpose of extracting underground
<br /> mined uranium-vanadium and
<br /> WHEREAS, on . October 12 1977 W. S. Dawson "FILED" an
<br /> application,a reclamation plan and r..ap, and the required fee, as required by law; and
<br /> W`REREAS, on October 28 1977 the Mined Land Reclamation Board approved
<br /> W. S. Dawson application and set bend; and
<br /> 4IHEREAS, on February 15 1979 , the `lined Laird Reclanation Board :ccepted
<br /> surety submitted by W.S. Dawson and such date shal.. be considered the
<br /> date of issuance of the permit and the anniversary crate for all ocl•.er purposes ; and
<br /> i
<br /> WHEREAS, the Mined Land Reclamation Board has made a finding, for the purposes
<br /> of issuing this permit, that:
<br /> 1) the application complies with the requirements of the Colorado
<br /> :fined Land R.eclamacion Act and all applicable local , state and
<br /> Federal laws; and,
<br /> 2) the operation will not adversely affect the stabilira of any
<br /> significant, valuable, and permanent man-made structures located
<br /> i
<br /> within two hundred feet of the affected land, except where there
<br /> is an agreement between the operator and the perscns having an
<br /> interest in the structure that damage to the structure is to be
<br /> compensated for by the operator; and,
<br /> I
<br /> 3) the proposed mining operations ar.d reclamation can be carried oa
<br /> in conforTaance with the recuirements of C. R.S. 1973, 3'.-32-116, as
<br /> amended (1976 Sess. Lass H.E. 1065) ; and
<br /> WHEREAS, for the purposes of issuing this permit , the c?.arator has made a
<br /> 11 satisfactory showing to the Board that he will employ during and after his
<br /> underground mining operations procedures reasonably designed to minimize
<br /> as much as practicable the disruption, from the underground min`nt, ope rations
<br /> and will provide for the rehabilitation of the affected land ttircu,h tna rehabilitation
<br /> of plant cover, soil stability, water resources, and other measures appropriate to the
<br /> subsequent beneficial use of such mined and reclaimed lands; Lnd that in the event
<br /> of the failure of his proposed reclamation plan, he will take whatever ireasuras r;hich
<br /> may be necessary in order to assure the success of reclamatior. of the lands effected
<br /> by his underground mining operations; ana,

<br /> WHEREAS, for the purposes of issuing this permit, a copy of the application
<br /> approved by the Mined Land Reclamation Board of the State of Colorado is attached
<br /> to .this permit and thereby becomes a part of the terms hereof .
<br /> I NOW, THEREFORE, pursuant to the authority set forth in the Colorado ?'.fined
<br /> '--and Reclamation Act, Article 32 of Title 34 , C.R. S. 1973, as amended , (1976
<br /> Sass. Laws H.B. 1065) the !:fined Land Reclamation Board of the State of Colorado
<br /> hereby issues a life of the mine permit to W.S. Dawson to enaa;�
<br /> is underground minin; for the purpose of extracting underground
<br /> mined uranium-vanadium on the following parcel of groune , co pit :
