Memorandum <br /> <br />FOR: J. A Kiger May 23,1996 <br />AAUI, ROAD CER'PIFICATION <br />The purpose of this memorandum is to address Certification of Colowyo's Haul Road Segment A and <br />Segment B. <br />It is my understanding that CDMG Hiles have changed to require, for all haul roads and access roads <br />constructed prior to August I, 1995 a "relevant showing, on a case bl' case basis, which may include monitoring <br />data or other evidence" that roads are in compliance with applicable performance standards. <br />As you are aware, Colowyo's haul road was constructed in 1977 and there is no one at Colowyo who <br />can certify the construction of the haul road. The revised CDMG regulation poses a problem because an <br />engineer cannot certify construction of a road which he did not witness ar supervise. To do so would risk <br />cancellation of their professional license. Far this reason, it is not possible for the Colowyo haul road <br />construction to be certified by a P.E.. <br />I can, however, provide the following qualitative haul road performance certification based in part on 1) <br />the reported 19 year performance history of the structure and 2) based upon my current observations of the daily <br />• pertotmance of the haul road <br />I am a mining engineer, registered in the State of Colarado, and experienced is the construction and <br />inspection of haul roads. <br />To the best of my lmowledge, based upon the available information regarding the reported, long terra 19 <br />year performance of Colowyo's Haul Road amd my ongoing observation of the performance of Colowyo's Haul <br />Road, I beheve there is sufficient quahtative evidence available to suggest that the Haul Road is in compliance <br />with the applicable performance standazds of the CDMG regulations in accordance with Rule 4.03.1. <br />'S's.-5fe~hen~.
