_ ~ iii iiiiiiiiiiiiiiii ~ <br />ses December 18, 1974 <br />MINED LAND RECLAMATION BOARD MEETING - Minutes - December 16, 1974 <br />The Board convened at 9:00 a.m. on December 16, 1974, in the Third Floor CgnFrronCe Room <br />of the Columbine Building at 1845 Sherman Street. All board members were present except <br />John Rold. <br />Mr. Ten Eyck asked for any comments and/or proposed changes to the minutes of the board <br />meeting held in November. No comments were offered, and the minutes were accepted as <br />prepared and distributed. <br />1. TURNPIKE CONSTRUCTION INC. - Highway 52 and County Line Road, Weld County - 37 Acres. <br />Mr. Bob Grogan and Mr. Fred Spallone representing Turnpike Construction, explained <br />their reclamation plan and operation activities to the board. Mr. Blake moved that <br />the permit be granted providing the ten acre plant site and stock pile area be included <br />in the application with a minimum bond being set at $35,250. Ross Chambers seconded <br />the motion, motion carried. <br />2. BRANNON SAND b GRAVEL COMPANY - City of Wheatridge - 60 Acres <br />Brannon Sand b Gravel Company was represented by Mr. Sellers, Mr. Cruise, Mr. Blashley <br />and Mr. Bell. Mr. Cruise gave a detailed presentation with excavation diagrams and <br />aerial photographs of their location with regard to their reclamation plans. Mr. Blake <br />moved that the permit be granted with t~iA bond being set at $1,000 per acre or $60,000. <br />Mr. Deborski seconded the motion, motion carried. <br />3. ENERGY FUELS - Letter of Credit <br />Mr. Ten Eyck explained to Mr. Charles I. Brown of Energy Fuels that since the question <br />of whether or not a letter of credit is a legally acceptable surety, a letter had been <br />sent to the Attorney General asking for an opinion in that regard. He further explained <br />that the board is unable to grant their permit pending a written response from the <br />Attorney General. <br />4. SCHMIDT CONSTRUCTION COMPANY - Christian Pit, Fort Carson, E1 Paso County - 480 Acres, <br />/. 40 Acre Phases. <br />Mr. Tom Ledgerwood represented Schmidt Construction and explained their operation to <br />the board indicating that the topography would not be changed very much and that the <br />reclamation would consist mainly of planting grass. Mr. Blake moved that the permit <br />be granted with the bond set at $120,000 for the 160 acre area intended to be mined <br />in the next five years. The motion was seconded by Ross Chambers, motion carried. <br />5. HIGHWAY DEPARTMENT - Attorney General's Opinion. <br />Because the board has not yet received an opinion from the Attorney General with <br />regard to bond requirement on operations of the Highway Department, Ross Chambers <br />moved that the board approve the four (4) permits requested by the Nighway Depnrrun•.ni; <br />Longview Ltd. Pit in l.arlmer County, Jnnitell Pit In E.l Paso County, Brecht Plt In <br />Logan County and Mc Endffer Pit in Weld County, with no bond required pending receipt <br />of that opinion. Andy Deborski seconded the motion, motion carried. <br />6. BENISEK CONSTRUCTION COMPANY - Mesa County - 10 Acres. <br />Andy Deborski moved that the permit be granted with bond being set at $15,000. <br />Norm Blake seconded the motion, motion carried. <br />7. FLATIRON SAND AND GRAVEL COMPANY - East of Boulder, Boulder County - 15 Acres. <br />Although Flatiron has a $39,000 performance bond with the county, the board determine<I <br />that they would have to have their own bond for the reclamation. Norm Blake moved llr:rt <br />the permit be prantecl with bond being ::et at $56,7.50 including, the 75 acres to be <br />affected over the next five year period. Andy Deborski seconded the motlon, motion <br />carried. <br />
