Note: The Division of Minerals and Geology ("Division") shall not be a party, but shall <br />participate in the heazing as staff to the Boazd. <br />III. ISSUES TO BE CONSIDERED <br />Presentations to the Boazd shall be strictly limited to the issue of whether the pending application <br />complies with the requirements of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, Sections 34-32.5-101 et sec .., C.R.S. (1999) ("Construction Materials <br />Act") and the rules and regulations promulgated by the Boazd. The parties shall limit <br />presentations to the question of whether the pending application should be approved or denied, <br />based on the issues stated below. <br />Is the application complete and accurate with respect to groundwater depletion on <br />riparian communities, floodway locations, floodplain mapping, bald and golden eagle <br />nesting sites and pit dewatering? (Rule 1.4.1(3)) <br />Will the operation minimize disturbances to the hydrologic balance specifically with <br />regazds to possible dewatering effects on ripazian habitat, including adjacent cottonwood <br />trees? (Sec. 34-32.5-116(4)(h) & Rule 6.4.8(1)) <br />3. Will the operation avoid unauthorized release of pollutants to groundwater and minimize <br />disturbances to groundwater quality, specifically with regards to objectors' water supply <br />wells? (Sec. 34-32.5-116(4)(d) & (4)(h)) <br />4. Will the operation avoid unauthorized release of pollutants to the surface drainage system <br />and minimize disturbances to surface water quality, including during 50- or 100-year <br />flood events, specifically with regards to petroleum products, dust control chemicals, and <br />sedimentation? (Sec. 34-32.5-116(4)(c) & (4)(h)) <br />Will the operation minimize disturbances to groundwater well quantity? (Sec. 34-32.5- <br />116(4)(h)) <br />6. Will the operation adversely affect Bald Eagles or Golden Eagles nesting within one mile <br />of the site? <br />Will the operation minimize disturbances to the hydrologic balance specifically with <br />regazds to possible "pit capture" during flood events?
