4) There are no aquifers in the permit area or the azeas adjacent to the permit area. <br />Refer to electric logs and strata identification. <br />Pit inflows are projected to be 100 to 200 gpm in the early pit development based upon <br />very generalized extrapolations from drill Hole data. This contribution is comprised of <br />20 to 30 gpm from coal seams and the remainder from fracture systems. Based upon <br />yields from drill holes, the sandstones are not projected to produce identifiable <br />quantities of water. As of eazly 1992 the pit has not progressed to the point of <br />development to encounter flows of water from fracture systems or perched water. <br />Pit water will be settled in the pit and pumped to Sediment Pond No. 1 where it will be <br />retained to meet NPDES requirements. As needed the water will be retained in <br />Sediment Pond No 1. for an extended period of time to meet the NPDES requirements. <br />The permittee has legal right to the waters by virtue of its surface ownership and the <br />unappropriated nature of the water to be encountered. As necessary or desirable, the <br />permittee will file on the water to establish a priority and seniority of water rights in <br />water court. <br />In order to continue assessment of the groundwater geometry, static water level <br />measurements continue to be collected. Measurements, attached as Appendix 4-3(b) <br />• and 4-3c, indicate spring rise in the perched water elevation. As discussed above, there <br />is no identifiable hydraulic connection between the water available in coals and in <br />fractures or in springs and seeps. There aze no regional or widespread continuous <br />aquifers in the permit or adjacent areas, and consequently, piezometric maps cannot be <br />developed. See Map 4-3 for spring elevations and other water data. Hydra <br />geologically, the springs and seeps are not connected (See logs and Map 4-3). There is <br />no correlation between the first water samples and the ones submitted as additional <br />information. <br />Monitoring of springs, seeps, and groundwater monitoring wells has continued since <br />permit issuance in accordance with the applicable monitoring program at any given <br />time. The current monitoring program is contained in Section 2.05. Hydrologic data <br />has been complied in the Annual Hydrologic Reports for the mine. These reports are <br />submitted annually. <br />Information concerning the general geology and hydrology can be found in the <br />following public information which is available to the Division from other state and <br />federal agencies.
