THIS PERMIT is issu=d by [!~e Mined Land Reclamation
Board, Department of Iddtur'al Resources, State of Colorado.
RECITALS
A. McCoy Aggregates, Inc. ("operator") desires
to conduct a mining operation known as McCoy Aggregates, Inc.
for the purpose of extracting Scoria
B. On Au ust 27 1g8; the Mined Land Reclamation'
Board ("the board" approved operator's application for [his
permit, fixed the amount of bond and directed that [his permit
be issued upon the filing with the Mined Land ?eclamation Division.
("the division") of t,ond i~ the amount so fixed in form and substance
approved by the division, and such bond nas been so furnished.
C. On August 27, tg8--' the t:oard made the following
findings:

Act, C.R.S. 1973, 3i-3=-10.1 et ;co. as amended ("the
Act") and with a!l applic~bls local, ;ta:= ar::: federal
laws;

of any significa•~t, valua;,le, a~•.d permanent mar+-made
structure IecateC NiC~-,ic t~no hundred feet of .the affected
land, except arhere ,here ;s an acreemen[ bet'~reen ooer-
a[or and the persons having ar, interest in the st n~c-
ture that damage [o [he structure is to be compensated
for by operator; and
3. the propose6 mini.~g and C°clamation operations can be
carried out in conformance with t`e reauirements of
the Act.
D. Operator has made a showing satisfactory to the board:
(1) [ha[ it will employ, during and after its underground
mining and surface operations, procedures reasonably designed
to minimize, as much as practicable, env;ronnental disturb-
ance from sur_h operation; (2) that ~t ~:r~ll :rp•,ide for
reclamation of the affected lands approaria[e to .he subse-
quent beneficial use of such lands; and (3) tnat, in [he
event of the failure of its proposed reclamation plan, it
will Cake ~.ehatever measures may be necessary [o assure the
success of reclamation of [he lands affected by such opera-
tions in accordance r•rith C.R.S. ig73, 34-32-101 et sea.
