M. Dominguez, Jr. appeared for the Plain-
tiffs. J. Robert Lowenbach, Assistant Weld County Attorney,
appeared for the Defendant Board of County Commissioners.
Thomas A. Connell appeared for the Defendant Bestway Paving
Company and Gilsabind Condivar.
THE COURT now having heard the arguments of counsel,
reviewed the record and the exhibits contained therein, and
being otherwise fully advised in the premises doth find:
1. That the allegation of the Plaintiffs that the Defendant
Board of County Commissioners exceeded its jurisdiction
by their failure to comply with the provisions of Sec-
tion 30-28-116, C.R.S. 1973 and Section 8 of the Weld
County Zoning Resolution is without merit inasmuch as
said Defendants did comply with the above stated statute
and regulation.
