April 10, 2000 <br />adequacy response <br />Dear Mr. Hurwonh: <br />The Division has reviewed your April 10, 2000 response to the Division's initial adequacy review of the permit <br />application for the McKenna Limestone Quarry and has identified the remaining adequacy concerns: <br />DIVISION O F <br />MINERALS <br />GEOLOGY <br />0.ECLAM ATION <br />MINING•SAFETY <br />Hill Owens <br />Governor <br />Creg E. Long <br />Division Director <br />BASIC REQUIREMENTS: A copy of a performance warranty form was supplied with the Division's <br />initial adequacy review for your use. Although that form, when signed, notarized and submitted, is necessary to <br />satisfying the requirements for approval of the application, it is not the form to use in supplying the $17,100.00 <br />reclamation bond. The performance warranty and financial wartanry are separate instruments. The financial <br />warranty (reclamation bond) requirement is satisfied thru use of one of a number of other forms which correspond <br />to the various types of financial warranty available to you. Acceptable types of financial warranties aze described <br />under Rule 4.3. <br />Please indicate how you wish to supply the $17,100.00 reclamation bond and the Division will send you <br />the corresponding financial warranty form. <br />NOTICES: You have supplied acceptable evidence of notifying the owner of record of the surface and <br />mineral rights to the land [o be affected by the mining operation. You have also provided possible evidence of <br />notifying So. Gas, inc. as requested. The Division, however, does no[ understand why the So. Gas, inc. notice is <br />addressed [o "Eton Liquors/So. Gas" at an address that does not correspond [o the one appearing for So. Gas, Inc. <br />on the Location Map supplied under Exhibit A in the permit application. <br />Please explain in acceptable detail why the notice to So. Gas, Inc., as an indicated owner of surface land <br />within 200 feet of the affected area, is addressed to "Eton Liquors/ So. Gas" in care of "Clayton Gams" at an <br />address which does not correspond to the one shown for So. Gas, Inc. on the Location Map included in Exhibit A. <br />AI[ematively, please supply evidence of the receipt of the notice of the application by So. Gas.
