Usncnni <br />~~~~~Z~ <br />'~AUG 0 8 2005 <br />LLuui°n a~ Minera!$ and Geology <br />Re: July 1S, 2005 Letter to Black Hawk-Central City Sanitation District; <br />Structure Agreement for Proposed Mining Operation, Clear Creek District <br />Water Providers, LLC, MMRR Quarry; Gilpin County, CO <br />Dear Ms. Soto: <br />The Black Hawk-Central City Sanitation District (the "District") advised Bands & Gesso <br />LLC in November 2004 that it cannot sign the proposed Structure Agreement for Proposed <br />Mining Operation submitted to it by Mr. Gesso in October 2004, <br />• The District has neazly completed its new sewer treatment facility at mile mazker 1.75 on <br />Highway 119. The treatment facility will contain millions of gallons of raw and partially treated <br />sewage in concrete tanks located partially underground. The plant will also store, contain and <br />use potentially hazardous chemicals. The plant also consists of a great deal of underground <br />piping and conduit with connectors to buildings and tanks. These facilities were not designed <br />with neazby blasting and heavy equipment earthwork in mind. <br />We have also been made aware that the plant is constructed near a geologic fault that, if <br />disturbed, could cause great damage to the plant and downstream water users. <br />Finally, Highway 119 traffic, access and egress from and to the plant site for delivery <br />trucks and sludge hauling vehicles is already a concern. The addition of gravel hauling trucks <br />and equipment may create serious traffic hazards and delays. <br />In order to address these issues, please provide us with: <br />a. Any and all geologic studies concerning your proposed operation; the geologic <br />conditions in the area and potential effects on surrounding properties; <br />b. Any projected dperating information including size and type of equipment needed <br />and projected need for the use of explosives and earth moving equipment and <br />• <br />7400 E.
