Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below aze adequacy review comments on the above-captioned Regular 112 Application for 314.14 <br />permitted acres. The decision date for your application is scheduled for November 25, 2004. Therefore, I <br />would appreciate a response from you on or before November 5, 2004. (Your response should include two <br />(2) copies). Any public comments that we receive on your application during the interim will be <br />forwarded to you. Please be advised that your conversion application may be deemed inadequate and may <br />be denied on November 25, 2004 unless the following adequacy review items aze addressed to the <br />satisfaction of the Division. <br />6.4.3 EXHIBIT C -Pre-Minin¢ and Mining Plan Maa(sl of Affected Lands <br />1. The pre-mining and mining plan maps will need to be revised to include the name and ownership of the <br />irrigation canal that runs adjacent to the abandoned railway line crossing the permit area in a northeast- <br />southwest orientation. Please provide revised maps. <br />6.4.4 EXHIBIT D - Minine Plan <br />2. On page 1 the applicant indicates that there will be a total of 120 acres to be excavated, of the total <br />314.14 aces permitted. The applicant further indicates on page 5 that reservoirs of 60 acres and 6 acres <br />will be created. Based on these criteria, it appears that there will be at least 54 remaining acres to be <br />backfilled, topsoiled, and re-vegetated with a grass mix. Please indicate if there aze any other affected <br />lands to be topsoiled, and re-vegetated. Please respond. <br />3. Please indicate the status of the relocations for the Texas Tea flow line servicing "Texas Tea LLC - <br />Nelson No. 5" and the Encana high pressure gas line. <br />4. The applicant specifies on page 3 that the lazgest surface azea to be worked at any one time will be 15-20 <br />acres and that the largest volume of overburden material to be stockpiled at any one time will be 100,000 <br />cubic yazds. On page 8 the applicant specifies that there will be concurrent backfilling and grading during <br />the mining phase.
