C~
~~~~~~~~
DON J. HOFF III I II I II I II IIII III
ATTORNEY AT LAW MINED LAND
July 8, 1988 l3ECLAMATICIN DIVIe II~IV 10259TH AVENUE
SUITE 209
GREELEY, COLORADO 60631
1303) 3566767
Mined Land Reclamation Board
Room 215
1313 Sherman Street
Denver, Colorado 80203
Gentlemen:
This office represents Dan and Joyce Tracy, who own Section 7 and
8, and the North half and the Southwest quarter of 18, all in
Township 10, Range 66, North of the West p.m., Weld County,
Colorado; and a part of the East half of Section 13, Township 10,
Range 67. The first three parcels are in Range 66, T 10, Range
66. The last one, Section 13 is in T 10, Range 67 North; West of
the 6th p.m. We are in receipt of certain information indicating
that an application has been made by Andesite Rock Company to
mine certain sand and gravel in the vicinity of the Tracy
property. We have not received any notice of any hearing or
comment period except that neighbors of the Tracys' have informed
them that a comment period expires at 5 o'clock on July 12, 1988.
I would request that you would extend the written comment period
until such time as the Tracys' can analyze the impact that a sand
and gravel mine would have on their property and their water
rights.
I would further request that you send copies of all notices of
the end of the comment period and any hearings which may be
conducted to this office and to Dan and Joyce Tracy at 58502 Weld
County Road 27, Carr, Colorado 80612.
In the event the comment period expires before we receive notice
of the expiration of the period, please consider this letter as
being in opposition to the granting of any permit for the reason
that it will interfere with the Tracys' use of their water
rights, as the water they use would travel through the proposed
sand and gravel mine and would pick up significant amounts of
sand and silt which it does not now contain. Further concern of
the Tracys' is that no provisions appear to have been made in the
application to insure that the applicant will not use or
otherwise interfere with the water of the down stream users.
Sincerely,
Don J. f
Attor ey a Law
DH/sh
