I • REOIIEST FOR OPERATOR NAME CHANGE <br />AND NOTICE OF INTERNAL REORGANIZATION <br />Colowyo Coal Company is a general partnership duly <br />organized under the laws of Delaware. A recent internal <br />reorganization has occurred with Colowyo Coal Company L.P., a <br />Delaware limited partnership, being organized. The partners of <br />Colowyo Coal Company, being Gracoal, Inc. and Gracoal II, Inc., <br />remain partners of Colowyo Coal Company L.P. <br />In previous meetings with the Division we have discussed <br />the mechanism by which such a reorganization should occur under the <br />Division's Rules and Regulations. It was agreed that under this <br />particular internal reorganization scenario, where the original <br />general partners continue to remain as the identical limited and <br />general partners to Colowyo Coal Company L.P., only a minor <br />revision would be required. This particular reorganizational <br />change does not incur any change in the effective control of the <br />company. (Rule 1.04(141)) <br />Colowyo Coal Company L.P. will continue the coal mining <br />activities at the Colowyo Coal Mine. We do not anticipate that <br />there will be any change in operations, personnel, or otherwise as <br />a result of this action that will have any impact to the Colowyo <br />Coal Mine permit. <br />• The bonding companies that posted the performance bonds <br />on behalf of Colowyo Coal Company have been contacted. They will <br />be issuing riders to change the name of the performance bonds from <br />Colowyo Coal Company to Colowyo Coal Company L.P. These riders <br />will be forwarded to you in the very near future. <br />Introduction <br />To revise the Introduction section of the Permit please <br />find attached replacement page 1 for inclusion into Volume 1. <br />Section 2.03.4 Identification of Interests. <br />To revise Section 2.03.4 of the Permit please find <br />attached replacement pages 2.03-7, 2.03-8 and 2.03-8a for inclusion <br />into Volume 1. <br /> <br />hR--d-~o <br />
