The following comments are submitted
in accordance with the memorandum.
The plan is not complete as required by 43 CPR 3809. The following additional
information will need to be submitted to facilitate our processing.
1. The disturbance area is not adequately outlined. The reclamation map
depicts approximately 50 reclaimed acres, Exhibit H indicates 20 acres
and the 112 permit application indicates 40 acres. This needs to be
clarified.
2. Exhibit A depicts the wrong legal description. The claim includes the
SE'~SW'~, not the SEA and SW's.
3. Exhibit D describes an overburden area, but no location is given; the
mining area is not depicted on any maps; a description of a marketable
limestone storage area is included, but no maps; and no maps are
available for the disturbed area. Plans for stabilization of these
areas during mining are also not included.
4. Exhibit E (Reclamation Plan) indicates 2:1 slopes, while Exhibit E
(Rule 6 compliance) indicates 1:1 and 80' slopes. The reclamation map
depicts something entirely different. This needs to be clarified.
5. Exhi,.i[ E (Reclamation Plan) outlines a specific seed mix, while
Exhibit E S.A. discusses test plots, etc. This is unclear.
6. Exhibit H discusses sedimentation control, but it is not described or
depicted on any maps. Specific sedimentation control will be necessary
to avoid high sediment levels in downstream drainages. A specific
system and design must be provided.
7. We do not know the CMLRB permit area and must be provided this
information to assess any specific responsibilities the BLM has for
operations (access roads, etc.) outside your permit area.
