Outfalls 001, 002, 003, 005, 006, 007, 008, 009, 025, and 028 are eligible for re]ief. The remaining permitted <br />outfalls are not eligible. <br />Relief maybe granted for each discharge occurrence only when necessary and shall not be granted when the pertrdttee has control <br />over the discharge. The pemuttee should endeavor to meet dre primal limitations whenever possible. The pemrittee will need <br />to show that exceedence of the applicable limitations were caused by precipitation and no other source and that the discharge was <br />beyond their control. <br />a) Fnr rainfall. to waive TSS and total 'von limitations, it is necessary to prove that discharge occurred within 48 hours after <br />measurable precipitation bas stopped. In addition, to waive settleable solids limitations, it is necessary to prove that <br />discharge occurred within 48 hours after precipitation greater than the 10.yeaz, 24-hour event has stopped. <br />b) Fnr annwmAr to waive TSS and total iron lunitations, it is necessary to prove that discharge occurred within 48 hours after <br />pond inflow has stopped. In addition, to waive settleable solids 1unitations, it is necessary to prove that discharge occurred <br />within 48 hours after pond inflow volume greater than the IO-year, 24-hour event has stopped. <br />Should a precipitation event or snowmelt occur, the permittee shall submit adequate proof in order for an ezemp[ion to be <br />claimed. Said proof shall be submitted as an attachment [o [he Dischazge Monitoring Report (DMR) for the appropriate period. <br />The Division shall detemune the adequacy of proof. As part of this determination, the Division shall evaluate whether the <br />permittee could have controlled the discharge in such a mammer that primary limitations could have been met. All manual <br />dewatering of the ponds shall meet TSS and total uon Gmi[ations. <br />3. Pnct-Mining Areac <br />Commencing at the time active mining has ceased and surface areas have been returned to the required contour al] applicable <br />dischazges may be eligible for limitations other than those specified in Parts LA.2. and LA.3. These post-mining ]imitations shall <br />remain in effect until bond release. The perntittee shall notify the Division upon cessation of active muting so that consideration <br />of appropriate penrtit modifications can be made. <br />• Calinit~' Psrnmatrrc <br />In order to obtain an indication of [he quantity of Salinity being discharged from the site, the permtttee shall monitor the <br />wastewater effluent on a quatYerly basis.
