Irrigation ditches were reestablished in 1992 and <br />limited irrigation started on portions of the Powder Mountain Ranch surface, <br />located in Sections 34 and 35, T10S, R98W and Section 1 and 2, T11S, R98W. <br />Portions of this activity are located above mined out and active areas of the <br />Roadside South Portals. The location of these buildings and ditches are shown on <br />Exhibit 46. <br />The former Colorado Ute Electric Association (currently owned by Tri-state <br />Generation and Transmission Association, Public Service of Colorado (PSCO), <br />and Western Area Power Administration installed a 345KV transmission line across <br />portions of the permit area in 1985. BLM subordinated their right-of-way agreement <br />#C-29423 to Powderhorn's Federal Coal Lease No. C-029889. See Exhibit 46 for <br />the location of the line and steel structures. Exhibit 20-5 was a worst case <br />subsidence study of the affect of mining on the structures. Exhibit 20-6 is a copy of <br />BLM's notice to proceed with construction across the coal lease and contains <br />• wording related to the subordination agreement. Exhibit 20-7 includes an <br />anticipated impact statement from the PSCO. Public Service Company upgraded <br />their transmission line up Coal Creek in 1985. BLM subordinated their right-of-way <br />to Powderhorn's Federal Coal Lease C-01538. Appendix 20-7 is a copy of an <br />agreement between PSCO and Powderhorn. In this agreement, PSCO agreed to <br />move their line if necessary to allow Powderhorn to mine the underlying coal and <br />Powderhorn agreed to notify them six months prior to mining under the line. <br />There are no other structures or farming above past and projected mining areas of <br />the Roadside North Portals mining area. Limited grazing is done above the <br />Roadside North and South Portal areas. <br />(b) Current mine plans do not involve additional mining below the Ute Water <br />Conservancy District facilities or pipelines.
