("Applicant") within the above <br />referenced Section 112 application have been and are of great interest to the City. The City's <br />initial comments/objecrions in this regard have previously been contmunicatcd to your office <br />pursuant to written correspondence prepazed by the City's engineer, Jefferey S. Simonson and <br />the City's attorney, Loyal E, Leavenworth, dated November 1, 2000 and December 12, 2000, <br />respectively. Mazty of these concerns were also reiterated by City representatives during the <br />Informal Conference conducted by your office in Rifle City Hall on January 4, 2001. In addition <br />to the concerns and concomitant City involvement above desczibed, the City has, in its own <br />regulatory capacity, been actively involved is reviewing Applicant's proposed raining operations <br />and the possible impacts presented therefrom under the City's Watershed District regulations. <br />Following numerous site visits to the proposed mining property by City Staff and <br />individual City Council members and the conunissioning by the City of a IIoodplain study (AEC- <br />RAS) for that portion of the Colorado River likely to be affected by Applicant's proposed m'n'^g <br />operations, the City entered into extensive negotiations with the Applicant for the purpose of <br />establishing and defining the nature, type of extEnt of measures that would need to be undertaken <br />by Applicant to adequately mitigate those the impacts -relevant both to the Section 112 <br />permitting process and other, broader land use and environmental matters - likely to be presented <br />by its proposed mining operations. <br />As a result of said negotiations and in conjunction with the permitting process provided <br />under its Watershed District regulations, the City•has recently reached an agreement with <br />Applicant. A copy of the Agreement is attached hereto for your reference as Exhibit A. In <br />addition, the City issued the Watershed District Permit (FINDINGS OF FACT, CONCLUSIONS <br />OF LAW AND APPROVAL OF WATERSFIED DISTRICT PERMIT NO. 1-01) to Applicant <br />on June 20, 2001, a copy of which is attached hereto for your reference as Exhibit B. <br />
