Shelton <br />Director <br />The Division has received a request from Bar 70 Enterprises to succeed the <br />above operation. The Division never received a bond and related bonding <br />agreement form for this operation, therefore no permit was ever issued. A <br />Certificate of Deposit was filed with Moffat County State Bank however, in- <br />dicating the operator's intent to submit bond. <br />In order to allow the Succession of Operator to occur without delay, the <br />Division is issuing your permit with the understanding that Bar 70 Enter- <br />prises will submit the necessary bond. <br />Should the request for a Succession of Operator be granted, you would be <br />released from any further obligation, and could then remove your bond from <br />the County Bank. If, however, the request is denied, we would require that <br />the existing Certificate of Deposit be filed with the Division with the ap- <br />propiate bonding agreement form, in order for your permit to remain in <br />effect without violation of provisions of Section 39-32-124, C.R.S. 1973. <br />If you have any questions, or need additional information, please contact <br />me. <br />Sincerely, <br />~~ <br />Brad Janes \~ <br />Reclamation eci ist <br />cc: Mr. Kent A.
