<br />~J <br />r1 <br />LJ <br />Demonstration for Retention of Pond 007 <br />1. BACKGROUND <br />Pond 007 was the original pond for the New Horizon #2 Mine. As seen on Map 2.05.3(3x1, <br />the area draining to this pond has been reclaimed to final contour. Not considering the flows <br />from Ditch C-18, 176.8 acres flows into the pond. If Ditch C-18 is allowed to permanently <br />drain into the pond, an additional 226.8 acres would flow to the pond. The pond is split into <br />two portions, one north of 5'" Street and the other immediately south of 5'~ Street. The two <br />sections are connected by two 42" CMP's under 5"' Street. <br />It is shown in this Attachmentthat the retention of Pond 007 meets all requirements of Rule <br />4.05.9(13). The post-mining use of the land is irrigated pasture. Livestock will use the <br />pasture to feed and the post-mine pond will be used to water these animals. <br />2. WATER QUALITY <br />Pond 007 has been discharging mine pit water and runoff water for many years. All tests <br />throughout the years show that the water quality is very good for its intended use to water <br />cattle. The discharge point has been subject to NPDES requirements for many years and <br />ho problems with the discharge exist. The water quality will exceed all State and federal <br />requirements. <br />The table shown below has water quality data for the pond from 2003 through 2004, <br />including 4 full suite surface water analyses. As is seen in the analyses, all parameters meet <br />State and Federal requirements according to Regulation 31 for CDPHE. Total dissolved <br />solids is high but still well within limits for agricultural use. The pH is near 7.0 and is closer <br />to neutral than most waters on the western slope of Colorado, which are normally more <br />alkaline. Selenium is very good, well below chronic and acute levels. One sample in August <br />of 1984 showed 5 micrograms per liter, which is still good for many western slope waters. <br />REVISED MARCH 2006 Attachment 2.05.3(3)-16-3 <br />
