DEPARTMENT OF NATURAL RESOURCES~MM r.w ~ .. III III'll 111 "II'll
D. Monte Pascoe, Executive Director 999
MINED I_,ANU RE(:LAA9A'I'ION
423 Centennial Building, 1313 Sherman Street
Denver, Colorado 80203 Tel. (303) 839.3567
David C. Shelton
Director
Novemebr 26, 1980
Ms. Ann Hodgson
Brannan Sand and Gravel
4800 Brighton Blvd.
Denver, Colorado 80216
RE: Pit l7 - "Turkey Flats" Conversion and Pit 29
Our file numbers: 74-136 and 80-183, respectively
Dear Ann:
On November 19 and 20, 1980, the Mined Land Reclamation Board approved
the continuances of consideration of the above captioned operations.
Before the Board can consider these operations, I will need the
following matters clarified: Turkey Flats - I need a written response
to my letter of November 13, 1980. Pit 2g - I need proof of local
zoning for mining and a written response to my letter of October 30,
1980. Since the December meeting is early due to the holidays, and
it will undoubtly take me some time to review these various items, I
suggest that you get the aforementioned items to me at your earliest
convenience.
I received the November 13th letter from Warren Cruise concerning the
proposed future land use for the lake to be left at the Pit 29 site.
The wildlife use seems quite adequate. The distinction as to whether
wildlife use for the lake constitutes a beneficial use for the water
or no[ is one that I am not qualified [o judge. That issue is one
that Brannan will have to resolve with the Division of Water Resources.
If you wish, I will pass a copy of this letter on to the Division of
Water Resources. Please let me know about this. It would be Simpler
if Brannan could resolve the water issues before Board consideration
of the Pit 29 permit application (a stipulation to the permit could be
avoided).
If I can clarify any issues on either of these two pits, please call me.
Sincerely,
Mark S. Loye
Reclamation Specialist
