Box 383 <br />fountain, CO 80817 <br />Re: Midway Pit Permit Application (File M-88-018) <br />Dear Mr. Vette: <br />We have recently completed a review of the Midway Pit permit application. Our <br />review, which is enclosed, indicates that some work is still necessary before the <br />Mined _and Reclamation Board can approve the permit. Most of the information we <br />still need can be obtained from Permits M-80-086 and M-80-156. We would encourage <br />you to use specific information from those permits, particularly for soils and <br />vegetation descriptions, whenever possible. <br />Regarding the mining and reclamation plans, we will need a much more detailed and <br />specific description of the anticipated activities at the Midway Pit. With these <br />specific descriptions, please include maps which show distinct mining and <br />reclamation areas, as well as the probable sequence and direction of mining and <br />reclamation activities. It is also necessary that we be provided with a map which <br />clearly shows the entire permit area with all mining related structures <br />(stockpiles, roads, building, scales, diversions, etc.) and the distinct mining <br />areas. This will greatly enhance our ability to review the revised mining and <br />reclamation plans in a timely manner. <br />E1 Paso County has indicated that they have not been approached for Special Use <br />approval. They have also indicated that the proposed mining and reclamation plans <br />may not be compatible with adopted county plans and/or zoning requirements. The <br />Mined land Reclamation Act does not allow the Board to approve a permit application <br />if an operation does not have county approval. Therefore, we suggest that you <br />contact the E1 Paso County Land Use Department, and initiate whatever actions are <br />necessary to resolve any outstanding issues. If you feel that a meeting between <br />Midway„ the County and Mined Land would be beneficial, please contact us. <br />I would like to take this opportunity to thank you for your efforts in permitting <br />this site thus far, However, I would like to emphasize that it will be absolutely <br />necessary to file a complete and concise permit application before seeking Board <br />approvi:.l in June. I strongly encourage you to contact the E1 Paso County Land Use <br />Department and attempt to resolve their concerns. I also suggest that you contact <br />the Federal Department of Transportation regarding the right to enter issue.
