<br />requires at least twenty-two categories of <br />maps and exhibits, which must be submitted <br />approval of an application by the MLRB. <br /> <br />information, including <br />and complete~9 prior to <br />11. MLRD Rule 2, Exhibit G, requires an applicant to <br />state whether his operation is expected to directly affect <br />surface or ground water systems, and if so, to provide :specific <br />information including, among other things, an estimate of project <br />water requirements. MLRD Rule 2.1.2(8) also requires the <br />applicant to indicate the water rights and sources of water he <br />has available to supply project water requirements. <br />12. Rule 2.1.2(8) requires the MLRB to invest.~gate the <br />water sources and rights, utilizing available sources to obtain <br />the necessary information prior to the MLRB's considers+~ion of <br />the Application. <br />13. Section 34-32-116(7)(8), C.R.S. (1988 Cum, Supp.) <br />requires mining reclamation plans to assure that disturloances to <br />the prevailing hydrologic balance of the affected land <and <br />surrounding area, and to the quality and quantity of wa+rer in <br />surface and ground water systems both during and after mining and <br />during reclamation shall be minimized. <br />14. Section 34-32-115, C.R.S., requires the MLRB to <br />deny approval of a permit if any one of the following e:Kist: <br />(a) The application is incomplete; <br />(b) The performance and financial warran+.ies have <br />not been provided; <br />(c) The applicant has not paid the required fee; <br />(d) Any part of the proposed mining operation, the <br />reclamation program, or the proposed future use is cont:cary to <br />the laws or regulations of Colorado or the United Staters; <br />(e) The mining operation will adversely :affect the <br />stability of any significant, valuable, and permanent man-made <br />structures located within two hundred feet of the affec+red land, <br />unless there is an agreement between the operation and °:he <br />affected persons; <br />(f) The mining operations will be located upon <br />specially classified lands, such as national or state parks or <br />recreation areas; and/or <br />-3- <br />
