Steamboat and Stone Canyons, Sections 5, 6, and 7, <br /> Township 3 North, Range 70 West <br /> Gentlemen: <br /> The Boulder County Zoning Resolution was amended on 9 October 1980 to exempt <br /> open mining operations from the lengthy Special Use Review process if such <br /> operations disturb less than ten acres of land and extract less .than 70,000 <br /> tons of rock. Since the quarries operating in the above sections investigated <br /> on 15 January 1981 were determined to be open mining small acreages with tonnages <br /> below these maximum use-by-right levels, no public hearings are relevant , <br /> pefore the Planning Commission nor before the Board of County Commissioners <br /> for the release of a Special Use Permit. Limited impact mining, however, <br /> was determined to be in excess of 50 cubic yards of overburden and mineral <br /> including pits and haul roads which was sizable enough to be governed by <br /> the Boulder County Uniform Building Code, adopted in 1979. Chapter 70 of <br /> this code requires a grading and excavation permit be obtained which may be <br /> applied for at the Boulder County Land Use Department for the purposes of <br /> reviewing any adverse effects on public ways, drainages, neighboring properties <br /> or persons. <br /> The quarries required to apply for a grading permit include the Phillips Stone <br /> Company in the West Half of Section S, Township 3 North, Range 70 West; Ignacio <br /> Vasquez in the East Half of the Northeast Quarter of Section 6, Township 3 North, <br /> Range 70 West; Johnson and Berry in the Southeast Quarter of the Northwest <br /> Quarter of Section 7, Township 3 North, Range 70 West; Neil Sprague in the South <br /> Half of the Southeast Quarter of the Northeast Quarter of the Northwest Quarter <br /> and the North Half of the Northeast Quarter of the Southeast Quarter of the <br /> Northwest Quarter in Section 7, Township 3 North, Range 70 West; and the Monty <br /> Pearson quarry in the Northwest Quarter of the North Half of the Southwest <br /> Quarter and the East Half less parts sold in Section 7, Township 3 North, Range <br /> 70 West. <br /> Parcel owners who have mining structures or buildings constructed since 1961 <br /> without permits will .be required to obtain the necessary building permits <br /> along with the related grading permit.
