RE: Status of Application, Don Kehn Construction Co., Timnath Pit,
File No. M-89-056.
Dear Ms. Hanson:
I would like to inform you of the status of the application and the
things that still need to be accomplished prior to the Division
rendering a decision.
First, I am not sure whether a copy of the complaint letter from
Hill and Hill (representing North Poudre Irrigation Company) was
forwarded to you for consideration. I realize that you have
informed me that you have a copy. I have enclosed another copy for
your use so you can compare it with the one you have to make sure
they are the same.
Second, the Division still needs proof that the public notice was
published on November 6 and 13, 1992.
Third, I noticed while reviewing the file that we have only
received copies of the white certified mail receipts as proof of
notice to surrounding landowners. These receipts have no post
office franking mark on them to prove that they were mailed. We
either need copies of the white receipts that show a post office
franking mark or copies of the green return receipts. We would
prefer copies of the signed green return receipts. Please forward
these at your earliest convenience.
Fourth, the Division has chosen Tuesday, January 19, 1993 as the
date far the informal conference. The conference will be held at
the Division of Minerals and Geology offices, 1313 Sherman Street,
Room 215, beginning at 9 A.M. The conference will be held because
of the complaint filed by Hill and Hill on behalf of the North
Poudre Irrigation Company.
Last, I have reviewed the permit file and cannot find any
agreements between the operator and the North Poudre Irrigation
Company that any damage to the ditch from the mining operation is
