Catrany <br />Amherst, CO 80721 Division Director <br />N/atural Resource Trustee <br />V <br />Re: Concerns Regarding the Rafert Pit Application, Phillips County Application No. M-2004-052 <br />Dear Mr. Rafert: <br />The Division received you letter concerning the Rafert Pit Application on September 7, 2004. We are <br />responding to each concern in order, as follows: <br />1) "I am concerned about the work that is done there, restricting these flows so that the water is backed up <br />or the natural drainage is altered". <br />Response: The mine plan proposes to start mining from the creek and proceed northwazd. The southern <br />portion will be the last portion mined . Any stockpiling that does occur will parallel the creek bed so as <br />not to restrict flow. No processing of material is anticipated in the pit. By following these procedures <br />there should not be any water backing up. Additionally, the applicant states in the reclamation plan that <br />the intermittent channel will be maintained when the pit is reclaimed, providing uninterrupted drainage <br />through the property. <br />2). " My second concern is that the mining may cause soil erosion that would adversely affect crops planted <br />in nearby fields" <br />Response: The Division's Rules and Regulations prohibit any offsite damage. If such damage occurs <br />the operator could be issued a violation and accessed civil penalties. <br />3) "Last, but not least I am concerned about noxious weeds that could be spread from this site onto <br />adjacent certified seed fields." <br />Response: In the Division's adequacy review the applicant was asked to provide the Division with a <br />Weed Control Plan. The applicant has responded and has committed to "utilize the services of our <br />Weed and Pest District Manager to control any weeds that become a problem at this site." <br />According to the Construction Materials Rules and Regulations, Rule 1.7.1(c) the Office shall approve or deny <br />the permit application within thirty (30) days of the date the office considers the application filed.
