Similar documents, for the Raymond <br />Pit, Permit No. M-98-023 application, are being forwarded to you under separate letter. <br />Slope stability for upslope areas have been addressed by the applicants commitment to <br />maintain affected slopes at grades not steeper than 2H:1 V (50% slope). The interlocking <br />faces of the angular talus material may produce stable slopes at grades steeper than <br />2H:1 V. However, in the absence of an engineering evaluation, demonstrating slope <br />stability at grades steeper than 2H:1 V, DMG has required and the applicant has agreed to <br />maintain affected area slopes at no steeper than 2H:1 V. DMG approval of the application <br />will be stipulated to clarify the permit requirement of 2H:1 V slopes. <br />Slope stability for downslope areas have been addressed by the enclosed geological <br />evaluation, conducted by Environmental Assessment Association. <br />The reclamation Act and Rules do not address operators using USFS lands for employee <br />housing, therefore this issue is not within DMG jurisdiction. However, DMG has <br />forwarded a copy of your 4/14/98 letter to the applicant to ensure they are aware of your <br />concerns. <br />Regarding your concern for encroachment onto USFS lands, the applicant has satisfied <br />"right of entry" for properties owned by Robert L. Conger and Robert V. Raymond only, <br />and not for USFS lands. Should mining/reclamation activities encroach upon USFS lands, <br />
