Please <br />feel free to contact Janet Binns at 303-866-4944 if you have any questions regazding her estimate. <br />Adequacy Review <br />The Division has conducted an adequacy review of the NOI in accordance with the applicable <br />provisions of the Act and the Regulations. We have the following adequacy questions: <br />Under the "Permittee" section of the NOI application form, both the "Individual's Name" and <br />the "Company Name" were filled in. In accordance with the requirements of Regulation <br />2.02.2(2)(a), we prefer that only one of these blanks be filled in. Please therefore submit a <br />revised NOI application page identifying which entity should be identified as the "Permittee". <br />2. In accordance with the requirements of Regulation 2.02.2(2)(b), please provide the name, <br />address, and telephone number of the "representative who will be present at and responsible for <br />conducting the exploration activities". <br />It is stated on the first page of the June 8, 2007 cover letter from Jerry Nettleton to the Division <br />that the NOI "duplicates information concurrently provided to the USDI-Bureau of Land <br />Management under a federal Exploration Plan notice, the State of Colorado, Boazd of Land <br />Commissioners under an Exploration Permit Application and Routt County Boazd of County <br />Commissioners through an Administrative Use Permit Application." In accordance with the <br />requirements of Regulation 2.02.2(2)(e), please provide proof of approval of the BLM and <br />Land Board exploration applications. The Division will be unable to approve the NOI until <br />proof of these specific approvals is provided. <br />4. On June 25, 2007, the Division received a "Referral Agency Notice of Application" (copy <br />enclosed) from the Routt County Planning Department regarding activities proposed in the <br />NOI. A discrepancy seems to exist between activities proposed in the NOI and activities <br />described to Routt County. <br />[t is stated on the second page of the June 8, 2007, NOI cover letter to the Division that "it is <br />anticipated that no road construction will be required to access the sites, since most are adjacent <br />to existing roads or undeveloped jeep trails...". However, it is stated under paragraph 10 of the <br />``Project Description/Nan•ative" of the "Referral Agency Notice" that "the only topsoil <br />stockpiles (or windrows) will be located along any roads that are constructed and at the drill <br />sites. Any recovered soil materials will be windrowed off the edges ofnewly-constructed roads <br />and on the upslope perimeter of the drill-sites." This language seems to suggest that roads <br />could be constructed under the NOI. <br />Please address this discrepancy. If it is the language in the "Project Description/Narrative" that <br />is incorrect, please submit a revised "Project Description/Nanative" to Routt County correcting <br />the discrepancy, and provide us with a copy of that revised "Project Description/Narrative". <br />5. In accordance with the requirements of Regulations 2.02.2(2)(f) and 4.21.4(3)(a), please <br />modify the text of the NOI to include the following statement: <br />
