III IIIIIIIIIIIII III Doc Date:12/11/2001 <br />• 5 IE - 2.03.7 RELATIONSHIP TO AREAS DESIGNATED UNSUITABLE FOR MINING <br />The areas of mining, processing and loading of the coal are not within any <br />area designated unsuitable for mining under Rule 7 or 30CFR 764 and 765. <br />The existing haul road does run through an area identified by the Colorado <br />Division of Wildlife as a sandhill crane flyway. This identification was made <br />approximately two years after the haul road had been permitted by the Colorado <br />Mined Land Reclamation Board in April 1977. Sun Coal Company reviewed the <br />situation with Tom Lytle, wildlife biologist for the Division of Wildlife. It <br />was his opinion that even mining activities could occur within the area iden- <br />tified without causing significant impact on this relatively minor flyway. A <br />copy of his letter may be found in CMLRD Project Files. <br />No occupied dwellings are located within 300 feet of mining, processing, or <br />• loading of coal at the Meadows No. 1 mine. However, a building that is occa- <br />sionally occupied as a dwelling is located adjacent to the mine access road and <br />is within 300 feet of said access road. <br />The dwelling is a two-room house of frame construction and is part of a <br />complex of three buildings at the site owned by Mr. John Eilts (lessor to Sun <br />Coal). Mr. Eilts uses the complex for storage and repair of various equipment <br />he owns. Typically, there are two bulldozers, a road grader, cattle truck, <br />flatbed truck, various pickup trucks, and numerous junk cars in various stages <br />of rr_pair or disrepair at the site. This information is reported to emphasize <br />the dwelling is not a typical home but is, instead, part of a shop facility. <br />The dwelling is used by employees of John Eilts and is generally limited by <br />the lack of modern sanitation facilities and no central heating.
