DEPARTMENT OF NATURAL RESOURCES
David H. Gelches, Executive Director
MINED LAND RECLAMATION DIVISION
DAVID C. SH EITON, Director
Richard D. Harvard Ave., Suite 400
Denver, CO 80231
Re: Wolf Creek Permit Revision
Uear tor. Wainwright:
D
S E P 2 8 1984
T. J. WAINWRIGHT
Peabody Coal Company (PCC) has requested a permit revision to the Seneca fI
Mine, Permit No. C-005-80. The revision request proposes a change to the
mining and reclamation plan for the Wolf Creek area and a scheduling change to
the mine plan in the Wadge coal area. The change in the Wadge area proposes a
• faster schedule than originally proposed. No other changes in the mining or
reclamation plan are proposed and therefore it will not be discussed further.
PCC proposes to increase the stripping depth to approximately 140 feet in the
lJolf Creek area by extending the pits south and west of the currently approved
area. Approximately 150 additional acres will be disturbed. All additional
acreage is within the currently approved permit boundary. Surface and coal
ownership belong to the state and are subleased to Peabody Coal Company.
OSM has reviewed the permit revision request and they determined that the
proposed revision does not affect the approved mining plan for Federal Coal
Lease No. C-19885 (see Attachment A). Therefore, there was no OSM involvement
in the review process.
All environmental baseline data for the additional area was included in the
original permit application with the exception of 40 acres that were not
surveyed for archaeological resources. PCC conducted a survey in the area
shown on Exhibit "5-1". A report is included in Table 5 of the permit
revision. No cultural resources were observed within the previously
unsurveyed 40 acres. The report was reviewed by the State Historic
Preservation Officer {SHPO). Based on communication with them (see Attachment
B), there will be no affect on cultural resources in the proposed permit
revision area. However, as stipulated in the original permit if during the
course of mining operations previously unidentified cultural resources are
dls~^r°r _d, PCr shall insure that the site is not disturbed and that the
• ^3i'~;'^ °i ..^r;a.~r cy~i~lai c.+ in t_y-p_ _f `_~'a Ya`1T al 7cn,_.=^ _r _._ _
Places Criteria 36 CFR, 60.4, in consultation with the SHPO.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
