<br />day of ~~. 1991, by and between Harry R. Willis, 103
<br />East Frnacisco, La Veta, Colorado 81055, and the Huerfano County Board of
<br />County Commissioners, a body politic and corporate, party of the second
<br />part, WITNESSETH that:
<br />WHEREAS, the party of the first part is owner of a parcel of
<br />land lying, being, and situate in the County of Huerfano, State of Colorado,
<br />more particularly described as follows,
<br />TO WIT:
<br />A tract of land located in Lot 1 (NE1/4 of the NE1/4) of Section 2,
<br />Town ,hip 29 South, Range 69 Wcst of the 6th P.M., being more part-
<br />icularly described as follows: Commencing at the NE corner of said
<br />Section 2; thence S 00-35-56 E, along the east line of said Section
<br />2, a distance of 536.12 feet; thence N 89-43-06 W, a distance of 30.00
<br />feet to the true point of beginning of the herein described tract of
<br />land; thence continuin~t N 89-43-06 w, a distance of 630.00 feet;
<br />thence S 00-35-56 E, a distance of 660.00 feet; thence S 89-43-06 E,
<br />a distance of 501.76 feet; thence N 10-25-40 E, a distance of 670.41
<br />feet to the point of beginning, containing 8.57 acres, more or less.
<br />WHEREAS, the said land above described contains deposits of cons-
<br />truction material satisfactory in quality and quantity for use to construct,
<br />alter, relocate, and maintain roads and highways of said County and the
<br />communities located therein; and,
<br />WHEREAS, the party of the second part is desirous of obtaining
<br />and acquiring such material for the improvement of roads and highways in
<br />the County of Huerfano.
<br />NOW, TFfEREFORE, in consideration of the premises, of the mutual
<br />covenants, agreements, and Promises herein contained, of the sum of one
<br />($1.00) dollar in hand paid by the party of the second part to the party
<br />of the first part, the receipt whereof is hereby acknowledged and confess-
<br />es, the parties hereto mutually agree, promise, and covenant that:
<br />1. The party of the first part agrees to, and hereby does sell to
<br />the party of the second part sixty-nine thousand nine hundred ninety-
<br />nine (69,999) tons of construction material in exchange for two hund-
<br />red (200) tons of crushed gravel.
<br />2. The party of the second part agrees to crush and stock pile the
<br />said two hundred (200) tons of gravel on the Willis property lying
<br />south of and adjacent to the above described parcel within one hundred
<br />fifty (].50) days from the commencement of crusher activities.
<br />3. The party of the second part shall have the right of ingress, egr-
<br />ess, and regress from and to the said property above described, and
<br />this right shall extend to its agent, contractors, and employees.
<br />4. The party of the second part shall have the right to excavate,
<br />remove, carry away, process, and store the said construction material
<br />until the last day of December, year of two thousand (2000), and if
<br />the party of the second part fails to do so, on or. before the last
<br />day of December, year of two thousand (2000), it shall forfeit its
<br />right to remove the balance, if any, of said construction material.
