For the Sedalia Recycling Center and Depository application, CDPHE issued a press <br />release on November 3, 2000, and the public comment period closed on December 4, 2000. The <br />only comment received was a letter from Douglas County Planning Division, Community <br />Development Department, copy attached. <br />I am concerned that you have not adequately informed Douglas County Planning Division of your <br />intentions. I am also attaching a compliance bulletin explaining the CD application process. Both <br />the Douglas County fetter and the compliance bulletin point out the fact that the County is the <br />issuing authority for a CD. The Douglas County requirements must be met, and their procedures <br />are to be followed in the application process. Currently, as a courtesy, CDPHE is reviewing the <br />technical aspects of the proposed design and operation of the facility. We compare them with <br />statewide technical requirements contained in solid waste regulations, 6 CCR 1007-2. Upon <br />completion of our review, and with your satisfactory responses to our questions and additional <br />requirements, we will recommend approval to Douglas County, who will then continue with the <br />County review process. <br />Another item of concern for permitting this facility is its location within an active clay mine area. <br />Both the Douglas County Planning Division letter and my letter dated October 24, 2000 addressed <br />to Darry Ferguson, point out the need to provide documentation that your facility can operate as <br />planned within the mine area. This would require concurrence by Colorado Division of Minerals <br />and Geology, as mine permit agency, and Robinson Brick Company. Any requirements they may <br />
