Cottony <br />Division Director <br />Natural Resource Trustee <br />Listed below are the adequacy review comments for the Haynes Hereford Ranch Pit 110 (c) Permit Application, File <br />No. M-2004-023. The Division of Minerals and Geology ("Division") is required to make a decision no later than May <br />7, 2004, therefore, your response to the following adequacy review concems should be submitted to the Division as <br />soon as possible. <br />I. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in the local <br />newspaper and all owners of record of surface lands, and easement holders that are on the affected land and within <br />200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by <br />proof of personal service. <br />Rule 6.3.4 Exhibit D- Reclamation Ptan <br />2. The mining plan indicates that mining of the deposit may be as deep at 15 feet. With the exception of the eastern <br />and western-most portions of the disturbed area, which are to be reclaimed to slopes of 10:1, the reclamation plan <br />does not specify the slopes that will remain once mining is complete. Please specify the expected slopes that will <br />remain once mining is complete. <br />Rule 6.3.5 Exhibit E- Map <br />3. The Reclamation Plan Map indicates that the access road and the stockpile area will be reclaimed. Please specify <br />how these azeas will be reclaimed. <br />4. The Reclamation Plan Map submitted with the application does not depict the expected topography of the site once <br />the site is reclaimed, or once mining is complete if no reclamation will occur. Please depict the expected <br />topography of the site once work at the site is completed. <br />Please be advised that the Phillips County 110(c) Permit Application may be deemed inadequate, and the application <br />may be denied on May 7, 2004 unless the above mentioned adequacy review items are addressed to the satisfaction of <br />the Division. Responses to these adequacy concerns must be received by the Division to allow adequate time for <br />review. If you feel more time is needed to complete your reply, the Division can grant an extension to the decision <br />date. This will be done upon receipt of a written waiver of your right to a decision by May 7, 2004 and request for <br />additional time. This must be received no later than the deadline date.
