Type of use: wildlife habitat and sub-imgation of adjacent wetlands. <br />iv. Amount: 0.30 cubic feet per second (cfs). <br />v. Appropriation date: December 31 , 1965. <br />b. Surface water right: Nation Spring No. 2. <br />Location: The spring is located in the NWl/4, Section 19, Township <br />49 North, Range 9 West, N. M.P.M., Montrose County, Colorado, and <br />is approximately 1,270 feet south of the north section line and 230 feet <br />east of the west section line of said Section 19. <br />ii. Point and means of diversion: This surface water right involves a <br />spring that issues from the hillside along the southwest side of a pond <br />known as the Nation No. 2 Pond. (The Nation No. 2 Pond is another <br />one of the water rights approved and granted in these Findings and <br />Ruling, and is more fully described in paragraph 4j below.) This <br />surface water right is thus never formally diverted, except that its flow <br />is captured and stored in the Nation No. 2 Pond. The Nation No. 2 <br />Pond typically fills in the spring of the year, holds water during the <br />summer months, and dries during the winter. There is a ditch between <br />the Nation No. 2 Pond and the Nation No. 1 Pond. The ditch trends <br />northerly from the Nation No. 2 Pond to the Nation No. 1 Pond, is <br />about 600 feet long, and carries water from the Nation No. 2 Pond to <br />the Nation No. 1 Pond. <br />iii. Type of use: wildlife habitat and sub-irrigation of adjacent wetlands. <br />iv. Amount: 0.12 cubic feet per second (cfs). <br />v. Appropriation date: December 31 , 1968. <br />c. Surface water right: Nation Spring No. 5. <br />i. Location: The spring is located in the NWl/4, Section 19, Township <br />49 North, Range 9 West, N.M.P.M., Montrose County, Colorado, and <br />is approximately 1,315 feet south of the north section line and 740 feet <br />east of the west section line of said Section 19. <br />FINDINGS AND RULING OF REFEREE -PAGE 2 <br />
