The UVWUA Articles simply do not <br />contemplate allowing a user to change the use of the water because <br />the UVWUA is an agricultural Project not an industrial one. <br />The Applicant has failed to provide the proper technical information <br />necessary for you to make your decision (Failing to satisfy MCZR <br />Section VI.6.2. and 7.) The Applicant has identified as its primary <br />source of processing water, a water right that it does not own and <br />cannot legally apply to the proposed industrial use. While we <br />recognize the Applicant may be able to purchase water rights from <br />another source, the site specific plan it is required to submit (MCZR <br />VI.6.2.) in order for you to approve the application will almost <br />definitely change in order to accommodate the new source of water, <br />whether it be ground water or some other source of surface water. <br />Whatever the eventual source may be, it is possible that the use of it <br />will impermissibly cause harm to existing agricultural irrigation systems <br />[MCZR IV.A.5.(h-(4)], fail to mitigate off site impacts to neighbors <br />(MCZR VI.B.4.) or be adverse to the health, safety and welfare of the <br />general public (MCZR VI.B.5.). <br />VI. CONCLUSION: APPLICANT HAS FAILED TO SATISFY THE APPLICABLE <br />CRITERA AND THE APPLICATION MUST BE DENIED. <br />Due to the complete lack of relevant water rights data, the Applicant's <br />failure to mitigate off site impacts, and the absolutely foreseeable harm to <br />existing Agricultural irrigation systems, this application must be denied. <br />7 <br />
