8 -Topsoil Management Pian that will assure all topsoil Is retained on-site for <br />reclamation - In the Colorado Division of Minerals application material, the topsoil <br />needed to reclaim the site to cropland has been calculated and committed to. The <br />Colorado Mined land Board, which.has authority over reclamation practicesand who <br />will set a financial warranty for this permit to ensure proper reclamation, will determine <br />the adequacy of the topsoil saved. The application calls for a minimum of 6 inches of <br />top50il t0 be pldCed Over the graded and reclaimed surface. From drill hole exploration, <br />there appears to be more than enough topsoil on-site to adequately meet this <br />reclamation standard. The plan is focal/ of the topsoil stripped from the site to be stored <br />in various stockpilestbermsoround the site for later use in reclamation. As such, al! of <br />the stored topsoil will be used in:reclamation. to essence, the same amount of topsoil <br />that exists on the site presently wilt exist on the site after reclamation; spread to the <br />same thickness as now exists. Further, as testified to in the initial public hearing, the <br />Colorado Mined Land Board and the Division of Mineral and Geology has been assigned <br />the duty of setting the financial warranty amount for afI mines within the state of <br />Coloradolo ensure that reclamation as proposed and approved in each permit is <br />satisfactority accomplished. The Division will not release a warranty until after all <br />reclamation is completed, the land stabilized, several growing seasons have passed, <br />and the site meets the Divisions standards. In addition, DMG staff from the Durango <br />Division w+ll periodically inspect the mine to.ensure topsoil has been stockpiled, seeding <br />(both temporary and permanent) has been accomplished, and that adequate amounts of <br />topsoil have been saved. <br />We are not sure what else we can provide the Planning Commission beyond the fact <br />that this DMG 112 permit, which will be subject to a financial warranty and periodic State <br />inspections, has been applied for asdescribed:- This area of reclamation is covered <br />under the purview of the Colorado Mined Land Reclamation Board through State law <br />and Rules and Regulations promulgated by the State, of Colorado. No other agency, . <br />including Counties or Municipalities, can require another financial warranty to ensure <br />reclamation. Further, Mr. Haldorson will not be able to operate until this State permit is <br />granted and we have alreadypromised the Planning. Commission that we will provide a <br />copy of the approved permit. <br />We respectfully submit that we have met all of the requirements necessary and have <br />provided all of the. information that we can.
